A tough year in store for experts – and solicitors

 Law Society directory with expert witness articleA number of new pressures on expert witnesses will combine to make this year a seminal one for experts in all disciplines, according to an article in the Law Society Gazette's Legal Services Directory. The initiatives are the cap on fees, introduced in October (with the setting of London levels lower than those outside London), the removal of immunity from prosecution, proposals for pre-trial assessment of witness evidence and the introduction of 'hot-tubbing' of witnesses already being trialled in the Family Court and Chancery Courts. The eventual introduction of Jackson LJ's proposals on civil costs will add to the squeeze.

In particular, the cap on fees, added to the pressure on solicitors to cut costs, could result in a full tilt flight on the part of experts who will feel undervalued. The real fear is that the quality of experts could be severely compromised. The Law Society's council member for child care lawyers, Christina Blacklaws, is reported as expressing fears that the lack of suitable experts could lead to delays that could constitute a denial of justice for the most vulnerable. The general view is that there will not be a stampede for the exits, as evidenced by the increases in entries on this site's Expert Witness Directory.

The squeeze on costs is affecting solicitors as well as expert witnesses, a subject alluded to by Law Society chairman John Wotton in his introduction to the Directory. It is one of a number of directories published regularly by the Gazette. Other subjects include charities and appeals – published to help solicitors engaged in finding recipients for bequests – expert witnesses, continuing professional development and alternative business models.

Expert witness consortium seeks feedback

 

The Consortium of Expert Witnesses to the Family Courts has appealed to solicitors for feedback on the effect of fee cuts, according to a report in the Law Society Gazette in January. According to the Gazette: “The group believes there are already difficulties in obtaining access to qualified experts and has objected to lower rates of pay in London compared with the rest of the country.”

The latter point refers to a Judicial Review called for by the group late last year. In a letter to consortium members, its convenor, Dr Judith Freedman, said: “We have been fighting the Government over their cuts to Legal Aid and to expert witnesses’ fees for over two years. However, the Government has capped all expert witness rates and, bizarrely, they have set the rates for experts whose office addresses are in London at one third lower than elsewhere.

“Now that the Government’s funding order is in place, we are pursuing legal action. One of the arguments we are making in our application for Judicial Review is that the Government made their decisions with an almost total absence of data. We also are arguing that these cuts will prejudice cases against vulnerable people who are on Legal Aid.”

Under the regime the non-London hourly rates for a neurosurgeon and a neurologist would be £171 and £153 respectively, but their London equivalents would receive £90. The rates can be exceeded in exceptional cases.

The application for Judicial Review, although specifically aimed at fee discrepancies, is also effectively an attack on the proposals as a whole. It is part of an almost-universal opposition to the Government’s proposals.

UK Coal sentenced for safety failings that cost four lives

UK Coal Mining Ltd has been ordered to pay £1.2 million in fines and costs for safety failings that cost the lives of four mineworkers in separate incidents at two collieries in Nottinghamshire and the East Midlands.

The company, of Harworth Park, Blyth Road, Harworth, Nottinghamshire, was sentenced at Sheffield Crown Court today (14 December) for four breaches of Section 2(1) and three breaches of Section 3 of the Health and Safety at Work etc Act 1974 in connection to the deaths.

IMO Secretary-General opens 27th IMO Assembly

 

 

PIRACY
The International Maritime Organization (IMO) has focused heavily on actions to stem climate change and to address piracy off the coast of Somalia, in what has been a busy and productive biennium for the Organization on the regulatory front, Secretary-General Efthimios E. Mitropoulos told delegates at the opening (on Monday, 21 November) of the 27th session of the Organization’s highest governing body, the Assembly. The meeting is being attended by more than 1,000 delegates from IMO Member States as well as from international governmental and non-governmental organizations.
